The second paragraph of article 22 of the Law 34/2002, of 11 July, on Information Society Services and E-Commerce (hereinafter, LSSI-CE by its acronym in Spanish), states the following:
1. Service providers may use devices for the storing and recovery of data on terminal equipment of the users, so long as these users have given their consent after being provided with clear and complete information on its use. In particular, this includes information regarding the purposes of data processing, in accordance with the provisions of the Organic Law 15/1999, of 13 December, on the Protection of Personal Data.
Whenever technically possible and viable, the user’s consent for accepting the processing of personal data may be given using the appropriate web browser or other application parameters, so long as they configure it during its installation or update through an express action to this effect.
The above shall not impede the possible storing or access from a technical point of view with the sole objective of communicating by an electronic communication network or, when strictly necessary, for the provision of a service of the information society expressly requested by the user.
As stated in the “Guide on cookie use”, published by the Spanish Data Protection Agency (Hereinafter, AEPD by its acronym in Spanish) in 2013, the LSSI-CE is applicable to any type of archive or device downloaded on the terminal equipment of a user for the purpose of storing data which may be updated or recovered by the entity responsible for its installation. The cookie is one of these devices of general use. Therefore, hereinafter, we shall refer to these devices generically as cookies.
Exempt from the fulfilment of the obligations established in article 22.2 of the LSSI-CE are the cookies used for any of the following purposes:

TYPES OF COOKIES AND THEIR PURPOSE

The information collected through this type of cookies is used to measure the activity on web pages, applications or platforms and to create user browsing profiles on those sites, applications and platforms. The aim of this is to make improvements based on the data regarding how users are using the service.
Advertising cookies: These are those which allow the most effective management of the advertising spaces which, as the case may be, the editor has included on a web page, application or platform which they use to provide the service requested. This deals with criteria such as the edited content or the frequency with which the adverts are shown.
Behavioral advertising cookies: These are those that allow the management, in the most efficient way possible, of the advertising spaces that, if applicable, the editor has included in a web page, application or platform from which the requested service is provided. These cookies store information on the behavior of users obtained through the continuous observation of their browsing habits, which allows the development of a specific profile to display advertising based on it.
